1. Acceptance of Terms

By accessing or using Vestko, including our website, web application, and Chrome extension, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

2. Account Responsibilities

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years of age to use Vestko.
• One account per person. Automated account creation is not permitted.

3. Acceptable Use

You agree not to:

• Use the service for any illegal or unauthorized purpose.
• Upload content that infringes on the intellectual property rights of others.
• Attempt to interfere with, compromise, or disrupt the service.
• Use automated tools to scrape, crawl, or extract data from the service beyond normal use of our Chrome extension.
• Impersonate another person or misrepresent your affiliation with any entity.

4. Your Content

You retain ownership of all content you upload to Vestko, including images and wardrobe data. By using the service, you grant us a limited license to:

• Process your images (background removal, resizing, categorization) to provide the service.
• Store your content on our servers and third-party infrastructure (AWS S3).
• Analyze your images using AI services for automatic categorization.

This license exists solely to operate the service and terminates when you delete your content or account.

5. Affiliate Links & Third-Party Products

Vestko's platform may contain affiliate links to third-party retailer websites. When you click on these links and make a purchase, Vestko may earn a commission at no additional cost to you.

• Product availability, pricing, and shipping are determined entirely by the third-party retailers, not by Vestko.
• Vestko does not guarantee the accuracy of product information, pricing, or availability displayed on the platform.
• Your purchase transactions are between you and the third-party retailer. Vestko is not a party to those transactions and is not responsible for any disputes, returns, or issues arising from purchases made through affiliate links.
• Affiliate partnerships do not influence how products are displayed or organized within your closet.

6. Service Availability

Vestko is provided "as is" and "as available." We strive to maintain reliable uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We are not liable for any downtime, data loss, or service interruptions.

7. Limitation of Liability

To the fullest extent permitted by law, Vestko and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $0 if you are on the free tier.

8. Indemnification

You agree to indemnify, defend, and hold harmless Vestko, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your violation of these terms, or your violation of any rights of a third party.

9. Termination

• You may delete your account at any time, which will remove all associated data.
• We reserve the right to suspend or terminate accounts that violate these terms.
• Upon termination, your right to use the service ceases immediately.

10. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the revised terms. We will notify users of material changes by posting the updated terms with a new effective date.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or the service shall be resolved in the courts of Ontario, Canada.
